I give devise and bequeath all my Freehold Messuages lands and tenements and hereditaments and all other my real and person Estate whatsoever and wheresoever and of what nature and kind soever unto my two sons, Charles Marjerison otherwise Charles Mather and Jonas Marjerison , their heirs executors and assigns Upon the Trusts and to and for the ends intents and purposes hereinafter expressed and declared of and concerning the same Upon trust that they the said Charles Marjerison otherwise Mather and Jonas Marjerison and the survivor of them and the heirs executors administrators and assigns of such survivor do and shall receive and take the rents issues and profits interest dividends and annual proceeds of my real and personal Estates and pay the same as they shall become due and be received unto my dear wife Chrisey or permit and suffer her to receive the same for and during the term of her natural life and also to permit and suffer my said dear wife to hold and enjoy all and every my household furniture plate linen and china and all other my personal Estate for and during the term of her natural life.
And from and immediately after the decease of my said dear wife I give and devise unto my said Son Charles Marjerison otherwise Mather his heirs and assigns for ever All those two Messuages or Dwelling houses with the Garden and other the appurtenances thereto belonging together with the parcel of land adjoining thereto situate at Rodley aforesaid being the westerly of two plots the division and boundary of each being a straight line intended to be drawn from the North Corner of the Garden Wall in the occupation of my said Son Charles to the Leeds and Liverpool Canal which division is to be effected by a fence wall to be erected by and at the joint expense of my said two Sons Charles and Jonas And also all those several closes pieces or parcels of land or ground situate on Coal Hill in Bramley aforesaid and known by the respective names of High Field, Bunker Hill, Bycliffe , Quarry Hill and Plantation together with the easterly moiety or half part of the Close or Garth called the Croft all now in my own occupation which Croft is intended to be divided into equal moieties by a line to be drawn parallel with the east and west sides and to run through the centre thereof
And I do hereby declare and direct that an intended new Street or Road of seven yards wide to be hereafter formed and made the centre whereof shall be the said line so to be drawn shall for ever remain open and unbuilt upon and which with three yards and a half to be added thereto as after mentioned shall form the said Street or Road and be used for all purposes whatsoever by my said Sons Charles and Jonas their heirs and assigns for ever, which first mentioned three yards and a half shall be formed and made by said Son Charles and his heirs and assigns into such Street or Road and for ever after kept in good repair by him and them.
And from and immediately after the decease of my said dear wife as aforesaid I give and devise unto my Son Jonas Marjerison his heirs and assigns for ever All that Cottage or Dwellinghouse situate at Rodley aforesaid and now in the occupation of Adam Whitham together with the Barn, Fold Yard, Helm or Shed and the easterly of the two before mentioned plots of ground the division of which is intended to be the said corner of the said garden Wall in the occupation of my said Son Charles to the said Canal And also all those two closes of Land situate on Coal Hill aforesaid and known by the names of Troublesome and Honey Fall with the Westerly moiety or half part of the said Close or Garth called the Croft to be divided by such parallel lines as before mentioned. And I do declare and direct that the said intended new road or street of seven yards wide to be hereafter formed and made the centre whereof shall be the said line to be drawn and that three yards and a half on the easterly side of the said last mentioned plot of ground hereby devised to my said Son Jonas and coextensive with the said line so to be drawn shall for ever remain open and unbuilt upon and which with three yards and a half to be added thereto before mentioned shall form the said Street or road and be used for all purposes whatsoever by my said Sons Charles and Jonas and their heirs and assigns forever which three yards and a half shall be made and formed by my said Son Jonas and his heirs and assigns into such street or road and for ever after kept in good repair by him and them
And I do hereby further order and direct that the Spring of Water now running through the premises devised to my said Son Charles as aforesaid into the premises devised to my said Son Jonas be allowed freely to run and flow through the present water course into and form the present Well; which said Watercourse and Well I direct shall be for the use of and maintained and kept in good and sufficient repair at the joint expense of my said two Sons their heirs and assigns forever And also that the Spring of water running into the corner of the said field called Bunker Hill devised to my said Son Charles as aforesaid shall be permitted to run and flow in its present course uninterrupted into the said fields called Honey Fall and Troublesome.
And from and after the decease of my said dear wife I give and bequeath the following sums to the persons herein after mentioned that is to say
To my daughter Sarah the wife of James Beanland of Manningham in the Parish of Bradford the sum of Nineteen pounds nineteen shillings ;
To the five children of my late daughter Hannah the wife of John Cole of Bowling near Bradford aforesaid Bookkeeper the sum of Two hundred and sixty pounds in manner following that is to say to the two sons of my said daughter Hannah the sum of Seventy Pound each and to the three daughters of my said daughter Hannah the sum of Forty Pounds each ;
to the ten children of my said Son Jonas Marjerison the sum of One hundred pounds to be divided between in manner following that is to say to his son Abraham the sum of Sixteen Pounds , to his six other sons the sum of ten pounds each , and to his three daughters the sum of eight pounds each
And I direct that the legacies given by this my Will shall be paid by my executors hereinafter named out of my personal Estate and that such legacies shall be paid to the respective legatees upon their respectively attaining the age of twenty one years which shall first happen.
And I do hereby further declare and direct that the said Charles Marjerison otherwise Mather and Jonas Marjerison their executors administrators or assigns shall immediately after the decease of my said dear wife or so soon as they conveniently can out of my personal Estate bequeathed to them as aforesaid set apart and appropriate the sum of two hundred and twenty pounds and stand and be possessed of and interested in the same upon the Trusts following that is to say In Trust continue the same upon such security or securities as the same may be on at the time of my said wife's decease or to invest or place out the same sum in or upon Government or real security at interest in the names of them my said trustees or the name of the survivor of them and from time to time to vary or change the same as often as they or he may see fit
And in Trust to pay the interest dividends and annual proceeds arising from the said sum of two hundred and twenty pounds unto my said daughter Sarah the wife of the said James Beanland by equal half yearly payments for and during the term of her natural life. And I hereby expressly declare and direct that the same shall be paid into her proper hands for her sole separate and peculiar use and benefit and without being in anywise subject or liable to the debts control or interference of her present or any future husband and that her receipt alone whether married or sole shall be a good and effectual release and discharge for the same
And from and immediately after the decease of my said daughter Sarah Beanland I give and bequeath the said sum of Two Hundred and twenty pounds unto and to be divided among her eight children now living in manner following that is to say to each of her Sons the sum of Thirty Pounds ten shillings and to each of her daughters the sum of Twenty Two pounds ten shillings
And I do hereby further declare and direct that my said trustees their executors and administrators and assigns shall immediately after the decease of my said dear wife or as soon as they conveniently can out of my personal Estate bequeathed to them as aforesaid set apart and appropriate the sum of four hundred and fifty pounds and stand and be possessed of and interested in the same upon the trusts following that is to say In trust to continue the same upon such security or securities as the same may be on at the time of said wife's decease or to invest or place out the same sum in or upon Government or real security at interest in the names of them my said trustees or the name of the survivor of them and from time to time to vary or change the same as often as they or he shall see fit
And in trust to pay the interest dividends and annual proceeds arising from the said sum of four hundred and fifty pounds unto the Widow of my late son Jarvis Marjerison by equal half yearly payments or in the direction of my said trustees if they shall think proper be paid and applied by them in the maintenance education bringing up or advancement of the children of my said Son Jarvis until the youngest thereof shall attain his or her age of twenty one years. And immediately upon such a child attaining the age of twenty one years I give and bequeath the said sum of four hundred and fifty pounds unto and to be divided among the six children of my said late son Jarvis in manner following that is to say to each of the three Sons the sum of One Hundred pounds and to each of the three daughters the sum of Fifty Pounds Provided always and I do hereby declare that if any of my before mentioned Grand Children shall die before their legacies shall become payable them the share of shares of the child or children so dying to which they would have been entitled under this my will shall go remain and be to the others and other of them if more than one in such proportions as is hereinbefore directed, but if only one then to that one child only But in case any such children shall depart life leaving lawful issue then and in such case the child or children of such deceased parent shall be entitled to the portion to which his her or their parent would have been entitled if he or she had been living and the same shall be divided among them in equal shares if more than one but if only one then to that one child only
And all the rest residue and remainder of my personal Estate after answering the purposes of this my Will aforesaid of which I shall die professed and also all other my real Estate (if any I have) and all Estates vested in me as Mortgagee in fee or otherwise I give devise and bequeath unto and equally between my said two Sons Charles Marjerison otherwise Mather and Jonas Marjerison their heirs executors administrators and assigns for ever according to the nature of tenure thereof as tenants in common and not as joint tenants |
